It's been seven years since I read Banks v Dretke and other opinions on this sordid prosecution. As I recall, Cook fingered Banks. The gun in Banks possession did not match the murder weapon forensics. Cook produced the correct gun and claimed it belonged to Banks. Because the SCt overturned THE SENTENCE of death, and not the conviction, he remained in jail all these years. The prosecutors derive immunity from a prosecutor who deserved it – this prosecutor deserves to be sued for misconduct.

Not too far different from the prosecutor in the Anthony Graves case in Texas that freed Graves a couple of years ago.

Just read that Banks agreed to life in sentence – and parole in 2024. If ever a man deserved a pardon, clearly, he appears to be such a man.
